Current drunk driving penalties

Drunk driving offenses have harsh consequences on your driving privileges, on your freedom, and on your wallet. The state’s drunk driving laws were changed in 2003 when the Michigan legislature passed Heidi’s Law. This means that a third or subsequent drunk driving offense within your lifetime is a felony, no matter how many years it has been since any prior offenses.

The penalties for Michigan drunk driving charges are as follows:

  • First offense: Up to 93 days in jail, a $500 fine, 45 days of community service, four or six points on your driving record, and license suspension for up to 180 days
  • Second offense: Up to one year in jail, a $200 to $1,000 fine, 30 to 90 days community service, four or six points on your driving record, license plate confiscation, vehicle immobilization for 90 to 180 days unless forfeited, and license revocation for one year or more
  • Third offense: Up to five years in prison, a $5,000 fine, 60 to 180 days of community service, six points on your driving record, license plate confiscation, vehicle immobilization or forfeiture, and possible license revocation for one to  five years

In addition to these penalties, those convicted of a drunk driving offense must pay up to $1,000 in driver responsibility fees to the Michigan Secretary of State for two consecutive years.  Repercussions are even more severe if your drunk driving charge involves an accident or the presence of a minor in your vehicle; these types of cases are almost always classified as felonies.
