Recent Changes in the Law

Drunk Driving

Effective September 30, 2003, the legal Blood Alcohol Content was reduced from a level of .10 grams or more to a level of .08 grams or more for the offense commonly known as Drunk Driving. The name of the offense has now been changed to Operating While Intoxicated (OWI).

While there is no longer a presumption that will help you in your defense against the charge of Drunk Driving, there is now a presumption that will hurt you. If you have a Blood Alcohol Content of .08 grams or more, then you are presumed to be intoxicated. The laws are constantly changing in this area; that is why it is imperative to speak with a knowledgeable attorney who is up-to-date on the changes in the law.
